Eligibility & Accounts

• You must be at least 16 years old (or the minimum age required in your region) to use Peak.
• You are responsible for the accuracy of your account information and for keeping your login credentials secure. You are responsible for all activity that occurs under your account.

Description of Service

Peak is an educational and professional ecosystem designed to guide users through structured skill development. We provide AI-generated learning plans, project-based skill verification, interactive practice and roleplay exercises, and collaborative workspaces (“Companies”) where users can create projects, assign tasks, communicate, and build teams.

AI-Powered Verification & Technology Disclaimers

The App uses advanced third-party AI models (including the Google Gemini API) to grade submissions, verify skill progression, and generate simulated roleplay scenarios.

• While we strive for high-quality evaluations, AI models can occasionally produce incorrect information or verify inaccurate submissions.
• All AI outputs, suggestions, and verification assessments are provided “as is.” You should exercise independent judgment before relying on them.

Workspaces, Collaboration & Financial Features

Users can establish or join collaborative workspaces (“Companies”) with defined roles — Officers, Managers, and Employees.

• Intermediary role only: The App acts solely as a platform to facilitate project collaboration, task allocation, and points/rewards management. We are not an employer, agent, or contracting party to any relationship, freelance arrangement, or employment structure formed between users in these workspaces.
• Vaults, credits & bounties: Workspace payouts, virtual balances, and demo credits are handled entirely at the discretion of the workspace Officers and Managers. We are not liable for any disputes arising from project assignments, approvals, or workspace credit distributions.

Payments, Credits & Virtual Balances

• Funding, credits, and virtual balances are processed securely through Stripe. By making a transaction, you agree to Stripe’s applicable terms.
• Demo credits and demo balances hold no monetary value and are provided for testing and simulation purposes only.
• Except where required by law, payments and credit purchases are non-refundable.

User Content & Intellectual Property

• Your content: You retain full ownership of any text, code, files, or project submissions you create, upload, or share. By using the App, you grant us a limited license to store, process, and display your content solely to operate and provide the App’s features.
• Our content: Peak retains all rights, title, and ownership in the App’s curriculum database, generated learning plans, skill trees, user-interface designs, logos, and system-generated exercises.

Acceptable Use & Restrictions

You agree not to:

• Attempt to manipulate, exploit, or bypass the AI grading and verification systems.
• Engage in harassment, hate speech, or abuse in private chats, group threads, or workspace channels.
• Upload unlawful, infringing, or malicious content, or impersonate any person or entity.
• Interfere with or disrupt the security or integrity of our backend systems (including Firebase and Supabase).

We reserve the right to suspend or terminate accounts that violate these restrictions.

Third-Party Services

The App relies on third-party services — including Google (Gemini, Cloud STT/TTS, Firebase, Analytics), Supabase, Agora, Stripe, Meta, and TikTok — to deliver its features. Your use of these features may also be subject to those providers’ terms and policies. We are not responsible for the practices of third-party services.

Disclaimers & Limitation of Liability

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Peak shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or workspace credits, arising from your use of the App.

Termination

You may stop using the App and delete your account at any time through Settings. We may suspend or terminate your access if you violate these Terms or use the App in a manner that may cause harm to us or other users. Provisions that by their nature should survive termination will continue to apply.

Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of Belgium, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or your use of the App will be subject to the courts of that jurisdiction.
